Sandra Frankel Statement on Eminent Domain Mediation

Brighton Town Supervisor Sandra
L. Frankel has issued the following statement in regard to mediation between
Faith Temple and the Town of Brighton.
“On Friday August 26th, the Town of Brighton and Faith Temple agreed in
principal on a settlement mediated by Judge Telesca. Yesterday we learned
that Faith Temple had reneged on the agreed-upon proposal, and because of
Faith Temple’s unilateral action to reject this agreement Judge Telesca
terminated mediation and issued the following statement to parties.

Judge Telesca, a well respected Federal Judge and highly experienced
mediator, worked tirelessly on behalf of both parties to mediate a
settlement which would have allowed the Town of Brighton and Faith Temple
Church to meet their needs, and we are extremely grateful to Judge Telesca
for his professionalism and dedication in seeking to facilitate a fair
settlement.
The Town of Brighton also worked long and hard and has negotiated in good
faith to reach last Friday’s settlement.
While the New York State Appellate Court’s highly favorable ruling has
cleared the way for the town of Brighton to acquire this critically
important parkland, we will remain open to the mediation process provided
that any proposed settlement will allow us to reach our goal of providing a
“central park” for our residents as directed in the 2002 Open Space
Acquisition and Development Plan Referendum.
The Town of Brighton has contended, in both State and Federal litigation,
that the 90 acres owned by the Church that are not affected by the Eminent
Domain proceeding is more than adequate for the Church’s need and the Town
of Brighton has not taken any action to prohibit the members of Faith Temple
Church from practicing their religious beliefs.”
